Sellers are required by law to disclose all material facts about the property they are selling. I have provided a link to a sample of the AAR Seller’s Property Disclosure form. The form is filled out by the seller(s) and acknowledged by the buyer(s) no more than 5 days following date of contract. In addition to this form there are several other areas of required disclosure; Lead Based Paint disclosure along with the EPA pamphlet, documentation for HOA or CC&Rs, 5-year insurance history called Comprehensive Loss Underwriting Exchange (or CLUE report).
There is very little that the Seller’s Property Disclosure does not cover. Some of the fields include: Legal Ownership and Description, Title Issues and Assessments, Safety concerns like zoning or code violations, roof, infestation, heating and cooling, plumbing, electrical, utilities, environmental issues.
A heads-up if you are selling your home on your own, these disclosures are required by law, they are not simply elements REALTORS® or MLS, and you will be required to provide the buyer with this information.
